1. Acceptance of terms
By accessing or using My Building Plans South Africa, you agree to these unified Terms of Service. If you do not agree, do not use the platform.
These terms apply across every active template, marketplace, workspace, and paid feature that is enabled for the platform.
2. Platform role and professional review
My Building Plans South Africa provides digital planning, visualisation, estimating, marketplace, and workflow tools. It is not an architectural practice, engineering practice, municipal approval authority, or substitute for a locally registered professional.
Any design, drawing, estimate, plan, BOQ, or visual output intended for construction, procurement, municipal submission, statutory approval, or legal reliance must be checked and signed off by appropriately qualified professionals in the relevant jurisdiction.
3. User inputs and account responsibility
You are responsible for the accuracy, legality, permissions, and completeness of the information, files, drawings, images, CSV data, and instructions you upload or enter.
You must keep your account secure and ensure organization users only access workspaces, orders, uploads, and customer data they are authorized to manage.
4. Payments, credits, refunds, and digital delivery
Paid services, credits, sessions, marketplace orders, digital downloads, and professional-service requests may have different fulfilment rules. The applicable feature clause below forms part of these unified terms when that feature is enabled.
Consumed credits, completed digital deliveries, fulfilled orders, and started paid processing tasks are generally non-refundable unless required by law or expressly stated in a written platform policy.
5. Prepaid Wallet, Commissions, and Balance Enforcement
Commercial accounts, suppliers, and service providers use a prepaid credit wallet system. All onboarding fees or account top-ups are credited 100% as prepaid credits to the account wallet to be used for platform services, lead unlocks, or rendering tools.
Applicable commissions (including marketplace product sales, lead procurement/unlock fees, and RFQ success or bidding fees) are automatically deducted from your prepaid credit wallet balance based on the admin-configured tiered or flat rates.
Your prepaid credit wallet must maintain a positive balance. If your balance becomes negative, your platform access will be restricted to billing and top-up pages only, and all public listings (including supplier product offers and directory profiles) will be suspended automatically until a positive balance is restored.
6. Limitations of liability
My Building Plans South Africa is supplied as a SaaS workflow and marketplace intermediary. To the fullest extent permitted by law, we are not liable for losses caused by unverified outputs, inaccurate user inputs, third-party professional services, supplier availability, local authority decisions, or construction decisions made without independent review.
Nothing in these terms excludes liability that cannot legally be excluded.
7. Visual Spaces image generation and boards
My Building Plans South Africa may provide boards, inspiration libraries, image generation, and visual presentation tools. Generated images are conceptual visual outputs only and are not construction drawings, engineering documents, municipal submission drawings, or guaranteed representations of real-world buildability.
You must have the rights to upload reference images, prompts, products, brands, and materials. Generated outputs may vary and must be reviewed before use in client presentations, procurement, construction, advertising, or professional advice.
Studio sessions, generation credits, and processing tasks are consumed when processing starts or the output is delivered, unless a written refund policy says otherwise.
8. Plans marketplace purchases and seller listings
My Building Plans South Africa may host a marketplace where organizations and sellers list plans, plan files, optional CAD/BOQ downloads, printing services, and related fulfilment items. Sellers remain responsible for the accuracy, ownership, licensing rights, completeness, pricing, and lawful sale of their listings.
Plan purchases grant only the license described at purchase. Buyers must obtain local professional adaptation, code checks, municipal submission preparation, and construction sign-off before relying on any plan for building work.
The platform may review, approve, reject, remove, or de-rank listings that are incomplete, misleading, infringing, unsafe, or non-compliant with marketplace rules.
9. Professional marketplace and verification badges
My Building Plans South Africa acts solely as a marketplace intermediary for professional listings, service offers, briefs, proposals, and direct-hire workflows. Users contract directly with independent professionals or organizations.
A verified or licensed badge is an administrative check of information available at the time of review. It is not a warranty of design quality, approval success, availability, professional conduct, or suitability for a specific project.
10. Organization plan CSV import
Organization CSV import tools are provided to help sellers manage their own plan catalogues at scale. Importing a file is a representation that the organization has rights to the plan metadata, images, PDFs, samples, prices, and links contained in the file.
Imported plans may be stored as drafts or submitted for review. Import tools must not be used to overwrite another organization’s plans, upload unlawful content, or bypass marketplace review controls.
